What’s your plan?

In April 2020 changes to Employment Law that will affect your employees.

The main areas for you to be looking at are:
1. Changes to holiday pay calculations
2. Provision of Statement of Main Terms
Employers will also need to provide additional information. The Statement of Main Terms (often referred to as an ‘SMT’) will need to include:
• Details of any probationary period
• Conditions of sick pay
• Maternity and paternity pay
• Notice to be given by either party to terminate the contract
• All benefits comprising ‘pay’ (vouchers, health insurance, food, accommodation etc. if applicable)
• Specific details of the expected days and hours of work (stating any variations)f this will vary it must state this)
3. Parental Bereavement Leave

What to do?

Start planning now to ensure you are compliant by April 2020.

Look at all your contracts and staff handbooks and work out which clauses terms and conditions need amending.

Get expert advice… and I don’t mean taking the advice of “Karen” on a Facebook forum, because unless Karen has employed an HR expert or Solicitor to do their contracts (in which case that would infringe copyright), how do you know that her template is correct? (no offence to any Karen’s… purely fictional).

 

One of the best pieces of advice I always give to practices and managers I support are “you are a manager, not a lawyer” …and the same advice applies when it comes to compliance. Employment Law/HR/Compliance are very much linked and if not done correctly can cause you huge problems… and can land you in trouble with the CQC or at a tribunal.

Although many managers wear multiple hats within their role, the responsibility and fall-out if anything isn’t done correctly or you don’t follow guidance is massive. Do you want to bear the brunt? In some cases it’s a situation where a practice owner or principal hasn’t supported you and allowed you to implement the required changes.
